GENERAL TERMS AND CONDITIONS OF SALES

Rocher Mistral is a simplified joint stock company with its registered office at Château de la Barben, 13 330 La Barben, registered with the RCS of Salon de Provence under number 877 640 581 (the “Company”).

  1. OBJECT AND SCOPE OF APPLICATION

These general terms and conditions of sale (the “GTC”) apply to the sale of tickets by the Company to any consumer (the “Buyer”). These GTCs apply to tickets sold individually by the Company, either directly at the entrance to the Rocher Mistral or online at www.rochermistral.com. Specific conditions apply to the purchase of tickets for groups of more than 20 people under the conditions described in article 4.3.  

The Buyer declares that he/she has read these GTC before purchasing tickets online and acknowledges that he/she has been informed that the validation of the order implies acceptance of these GTC without restriction or reservation. The applicable GTC are those in force on the date of validation of the order. The Company reserves the right to modify these GTC at any time by publishing a new version on the Site. The essential characteristics and prices of the tickets sold are available on the Site and at the entrance to Rocher Mistral. 

 

  1. INTELLECTUAL PROPERTY

The Company retains full and complete ownership of its intellectual property rights, in particular with regard to its brands and other identification signs. The Buyer shall not copy or imitate them, directly or indirectly. Any reproduction of the Company’s brand and identification signs is subject to prior written approval by the Company. 

 

  1. DEFINITION

Terms beginning with a capital letter in these GTC have the following meaning: 

 

“Adult”: means any person aged 13 or over on the day of access to Rocher Mistral. 

“Child”: refers to any person aged between 6 and 12 years inclusive on the day of access to the Rocher Mistral. 

“Ticket”: refers to the ticket allowing access to the Rocher Mistral and to all its services and activities open to the public, during a day when the Rocher Mistral is open to the public, for the benefit of a natural person, on a specific date (“Time-Dated Ticket”) or indefinitely (“Freedom Ticket”), under the conditions described in these GTCs and whose essential characteristics and price are described on the Site. 

“Time-stamped Ticket”: means the ticket allowing access to the Rocher Mistral and all its services and activities open to the public, during a day 

“Liberty Ticket” : means the electronic ticket allowing access to the Rocher Mistral and to all its services and activities open to the public, during a day when the Rocher Mistral is open to the public, for the benefit of an individual, for a period of time chosen by the Purchaser when ordering the Ticket and not for a specific day of visit, valid until the last day of the period chosen by the Purchaser when ordering the Tickets and mentioned on the Ticket and subject to the capacity of the Rocher Mistral, on the day chosen by the Purchaser to visit the Rocher Mistral. Freedom Tickets are not offered for sale at the entrance to the Park. 

“Season Pass”: means the ticket allowing unlimited access to the Rocher Mistral and all its services and activities open to the public, during the Rocher Mistral’s public opening hours, for the benefit of a natural person, from the day of purchase until the expiry date shown on the ticket. 

“Free Child”: means any person under the age of 6 on the day of access to the Rocher Mistral. 

“Group”: refers to a group of at least twenty (20) people taking the Mistral Rock Tour together on the same day. 

 “Price”: refers to the unit value of a Ticket, in euros, including all taxes, as mentioned on the Site on the day the order is validated by the Purchaser or at the entrance to the Rocher Mistral on the day of purchase at the entrance to the Park. 

“Site”: refers to the Rocher Mistral’s online ticketing service 

 

  1. METHOD OF PAYMENT

 

       4.1 Purchase of Tickets on the Website 

To purchase a Ticket on the Site, the Purchaser must : 

 

1/ Go to the Site and click on the “Book” tab 

2/ Follow the instructions mentioned on the Site and in particular: select the type and number of Tickets desired, then click on “add to basket” and then “next”. 

3/ Check the order, accept the GTC and click on “next”; if the Buyer wishes to modify his/her order, he/she can do so by deleting the Ticket(s); 

4/ If the Buyer is a new customer, he/she must create an account by providing his/her email, password, title, surname, first name, telephone number, postcode, town and country. If the Buyer is already a customer, he/she must connect to his/her account by providing his/her email address and password. 

5/ Choose your payment method. Fill in the credit card number and the related data, then click on “Validate”. Once the transaction has been finalised, the Buyer will receive an email with details of the payment and his Tickets. Each Ticket is nominative and personal and cannot be resold by the Buyer. 

 

    4.2 Purchase of Tickets at the Rocher Mistral entrance 

 Time-stamped Dated Tickets, allowing immediate access to the Rocher Mistral enclosure and all of its services open to the public that day. 

      

4.3 Purchasing Tickets for a Group 

A Buyer wishing to order Tickets for a Group can benefit from preferential rates under the conditions presented in the general conditions of sale for Groups. The purchase of Tickets for a Group can be made from the sales department by email or telephone using the contact details indicated at the top of this document. 

 

  1. PRICE

The prices of the Tickets are those indicated on the Website and/or at the entrance to Rocher Mistral and may depend on the category of Tickets. The Price of a Ticket includes access to the Rocher Mistral, excluding any catering service in the restaurants of the Rocher Mistral or any other personal expense such as the stands of the Pôle Marchand. With regard to the purchase of Tickets online, the duration of the validity of offers, promotional conditions and Prices is determined by updating the Site. The telecommunications costs allowing access to the Site remain the sole responsibility of the Buyer. Reduced rates are applicable on tickets sold at the entrance to Rocher Mistral. 

 

  1. PAYMENT TERMS

The Ticket Price must be paid in full at the time of ordering. 

 

     6.1 Purchase of Tickets on the Site: 

The payment of the Price is made only by credit card. The bank cards accepted are those of the Maestro, Carte Bleue, Visa and MasterCard networks. Bank charges incurred by the transaction for any reason whatsoever remain the responsibility of the Buyer. In the event of non-payment of the order, the Company reserves the right to terminate the order and, if necessary, to cancel the Tickets which would have been issued in the name of the Buyer and sent by email. Payments made on the Site are secured by the use of an encryption process guaranteeing the confidentiality and security of data (3D Secure system). 

 

     6.2 Purchase of Tickets at the entrance to Rocher Mistral 

The purchase at the entrance of Rocher Mistral of one or more Tickets gives rise to payment in one go by bank card (Mastercard, Carte Bleue, Visa, American Express, JCB), in cash or by means of checks. holidays under the specific conditions set. 

 

  1. MODIFICATIONS, EXCHANGES AND REFUNDS OF TICKETS

Tickets cannot be modified, exchanged or refunded. 

 

  1. NO RIGHT OF WITHDRAWAL

In accordance with Article L 221-28 of the Consumer Code, you do not have a legal right of withdrawal for the purchase of a Ticket for a date or according to a determined frequency. 

 

  1. OBTAINING AND USING THE TICKET

Tickets purchased online are sent by the Company to the Purchaser by e-mail, in electronic format. The Company does not send Tickets by post, fax or SMS. Entrance to Rocher Mistral is authorized on presentation of Tickets printed by the Buyer. The presentation of the Electronic Ticket on the Purchaser’s smartphone-type mobile phone requires that the latter has a good screen resolution so that the bar code can be read. 

Tickets purchased at the entrance to Rocher Mistral are issued the same day. In case of loss or theft, no duplicate will be issued. Complaints must be made, where appropriate, in writing to the Company’s Visitor Relations department. 

At the entrance to Rocher Mistral, the Company reserves the right to request the production of a valid identity document for the verification of the application of the pricing conditions to holders of Tickets purchased on the Site. Holders of Rocher Mistral Access Tickets can leave the enclosure of Rocher Mistral and re-enter it with the same Ticket during the period of its date and time of validity, subject to having reported before their exit. to receive a countermark. 

All Tickets, including Season Passes, give access to shows and facilities at Rocher Mistral open to the public on the day of the visit by their holder, subject to access restrictions based on visitor safety. 

 

  1. PERSONAL DATA

When purchasing Tickets online, the Buyer will be required to create an account to purchase Tickets. When creating the account by the Buyer, the latter must enter the following data: email address, title, surname, first name, telephone number and postal code. The Electronic Tickets are nominative and the Company therefore collects the names of the people participating in the visit of the Rock Mistral. All of the personal data collected by the Company from a Buyer when purchasing a Ticket online is subject to computer processing under the responsibility of the Company. This treatment is intended to treat the  

request of the Buyer, to manage visitor access to Rocher Mistral and to offer the Buyer commercial offers relating to Rocher Mistral and all of its business partners. Personal data may also be used by the Company for statistical purposes. The Purchaser may also consent, at the time of collecting his personal information, to receive information and promotional offers from Rocher Mistral and/or its partners. To do this, simply tick the corresponding boxes. The recipients of the Buyer’s personal data are the personnel of the Company and the commercial partners of Le Rocher Mistral. 

In addition, the Company also collects the personal data of visitors who file a complaint with the Company’s Visitor Relations department. 

All personal data collected by the Company is kept for a period of three years from the date of the end of the contractual relationship between the Buyer and the Company. In accordance with Regulation (EU) 2016/679 known as the General Data Protection Regulation (“GDPR”), natural persons whose personal data has been collected by the Company have a right of access to data concerning them, to rectification, interrogation, opposition for legitimate reasons and prospecting at the following address: Château de la Barben 13 330 La Barben, accompanied by a copy of a signed identity document. 

 

  1. LIABILITY

The Company cannot be held liable in the event that the non-performance or poor performance of its obligations is wholly or partially attributable to the Buyer and the holders of the Tickets visiting the Rocher Mistral, to the unforeseeable and insurmountable fact of a third parties or a case of “force majeure”. 

The Company cannot be held liable for any anomalies that may occur during the ordering, processing, downloading or printing of Ticket(s) attributable either to the Buyer or to the unforeseeable and insurmountable fact of a third party. foreign to the service, or to a case of force majeure. Similarly, the Company cannot be held liable for damage inherent in the use of the Internet network, in particular a break in service or the presence of a computer virus. 

The Buyer and all Ticket holders undertake to comply with these T&Cs, all the internal rules applicable within the Rocher Mistral enclosure on the day of the Rocher Mistral visit and in particular the safety rules. as well as all the instructions and instructions relating to the behavior to be adopted within the enclosure of the park. The Purchaser and all Ticket holders also undertake to behave courteously and respectfully towards Rocher Mistral staff and other visitors.  

In the event of non-compliance with all of these rules within the Rocher Mistral enclosure, the Company reserves the right to terminate your visit early. In this case, the said visitor(s) may not claim any compensation whatsoever, nor any Ticket refund. 

 

  1. INSURANCE

Rocher Mistral has taken out civil liability insurance contract no. 042 640 539 with the insurance company Allianz. 

 

  1. COMPLAINT

Any complaint relating to the purchase of a Ticket or a visit to Rocher Mistral must be sent to the Company, as soon as possible, by registered letter to the registered office of the Company as mentioned at the top of these GCS or at the following address: contat@rochermistral.com  

Complaints can be made by means of forms, made available to visitors at the Rocher Mistral reception. The complaint must imperatively specify the reasons for your dissatisfaction and the date of your visit to Rocher Mistral. In order to avoid any dispute, proof of visit (entry tickets, vouchers, etc.) must be attached to the complaint. 

 

  1. DISPUTES

The Buyer, as soon as he is a consumer, has the possibility of having recourse free of charge to a consumer mediator with a view to the amicable resolution of a dispute, in relation to these GCS, which would oppose him to the Company. . The Buyer is informed that referral to the mediator can only take place after having first attempted to resolve the dispute directly with the Company by means of a written complaint.

If mediation fails, any dispute may be brought by the most diligent party before the French court with territorial jurisdiction. The T&Cs are subject to French law.
